EMOTE EXPRESS LEGAL TERMS AND CONDITIONS

1. TERMS AND CONDITIONS OF USE

1.1. Introduction: Emote Express is a platform for interaction, messaging, multimedia content, and professional services operated by EmoteExpress LLC under the laws of the State of Connecticut, USA. By accessing or using the application, you agree to be bound by these terms.

1.2. Eligibility and Registration:

  • Minimum Age: You must be at least 13 years old (or the legal minimum age in your jurisdiction) to use the App.
  • Account Responsibility: You are solely responsible for maintaining the confidentiality of your credentials and for all activities that occur under your account.

1.3. Intellectual Property: All software, visual design, interfaces, logos, and source code of Emote Express are the exclusive property of EmoteExpress LLC. Reverse engineering, copying, or unauthorized distribution of the software is strictly prohibited.

1.4. External Services and Payments:

  • External Payments: Any transaction for courses, consulting, or services conducted outside the Emote Express interface is the sole responsibility of the parties involved.
  • In-App Purchases (IAP): Internal purchases are governed by the specific rules of the app stores (Apple App Store / Google Play Store).

2. PRIVACY POLICY

2.1. Data Collection: EmoteExpress LLC collects strictly necessary information: Identification (name, email, profile picture), Technical Data (device model, OS), and User Content shared publicly.

2.2. Data Usage and Protection: We do not sell your personal data. We implement standard encryption and do not track precise location without explicit consent.

2.3. User Rights: You may access, rectify, or request the deletion of your data at any time via: contacto@emoteexpress.com.

3. MODERATION AND CONDUCT POLICY

To ensure a safe environment, EmoteExpress LLC strictly prohibits:

  • Hate speech, discrimination, or harassment.
  • Incitement to violence or illegal activities.
  • Identity theft or the use of bots.
  • Spamming or distribution of malware.

Failure to comply will result in content removal or permanent account termination.

4. APPENDIX: CHILD SAFETY AND MANDATORY REPORTING

EmoteExpress LLC maintains a zero-tolerance policy regarding the exploitation of minors.

4.1. Prohibited Content Definitions:

  • Child Sexual Abuse Material (CSAM): Any visual or textual representation (including AI-generated imagery) that depicts the sexual exploitation or abuse of a minor.
  • Child Endangerment: Content that encourages or promotes self-harm, violence, or dangerous activities involving minors.
  • Grooming: Any attempt to establish predatory contact with a minor.

4.2. Mandatory Reporting (U.S. Federal Law): In accordance with 18 U.S.C. § 2258A, EmoteExpress LLC is legally obligated to report any knowledge or suspicion of CSAM to the National Center for Missing & Exploited Children (NCMEC) and law enforcement.

4.3. Enforcement: We utilize automated filters and human moderation. Users must report suspicious activity using the in-app tools. Reports regarding minors are treated with the highest priority.

5. LEGAL DISCLAIMER

  • Third-Party Content: EmoteExpress LLC acts as a technological intermediary and is not responsible for user-generated opinions or legality.
  • "As Is" Basis: The application is provided without guarantees of uninterrupted service.
  • Limitation of Liability: The user assumes all risk for decisions made based on platform information.

6. COMMUNICATIONS AND UPDATES

  • Notifications: By registering, you agree to receive administrative and security emails from EmoteExpress LLC.
  • Amendments: This document may be updated at any time. Continued use constitutes acceptance of the new terms.
